Many times, the custodial parent will be eligible to receive child support payments from the non-custodial parent, but certain factors must be present in order for this to happen.  If there is a large disparity in the earnings of each parent then child support will likely be granted.  For example, if one parent earns a six-figure income while the other parent was a stay-at home parent during the marriage, chances are the one making more money will have to make child support payments if they are not the custodial parent. 

There are a number of steps that must be taken when trying to obtain child support, including:

  • Locating the child’s other parent:  The other parent’s location information will be necessary in order for you to be able to obtain child support, and you will need to know their address and employer information. 
  • Establishing legal fatherhood (paternity):  The father’s biological identity will need to be proved before child support will be ordered, and this can be done through DNA testing.
  • Resolving terms of the child support payment: Either the parents will have to come to an agreement about the child support payments or it will have to be decided by court.
